Case law – the Supreme Court of Cassation awards a Decision dealing with Surviving Clauses matters
The Supreme Court of Cassation of the Republic of Bulgaria has recently awarded a Decision reasoning the validity of Surviving Clauses in cancelled contracts to certain extent. According to the Decision, a Seller shall be entitled to retain installments paid thereto by the Buyer prior to contract cancellation if such cancelled contract explicitly provides for that (Surviving Clauses).
